ORDER On August 28, 1995, appellant appealed from the contracting officer's denial of appellant's request for an equitable adjustment relating to its contract for construction of a weather station. Subsequently, appellant filed for bankruptcy. Respondent and the bankruptcy trustee agreed to settle the matter. The Bankruptcy Court approved the settlement. On December 5, 1997, respondent advised the Board that the respondent has issued a contract modification implementing the settlement and that respondent has paid the settlement amount. Based on the above, respondent moves to dismiss, because while "bankruptcy proceedings are not complete, there are no outstanding issues in this case." Respondent's Motion to Dismiss.
