ORDER On November 3, 1993, appellant, Camtech Company (Camtech), was awarded a contract by respondent, the General Services Administration (GSA), to supply the Government with tracking fixtures. The contract called for the delivery of the fixtures within ninety days after receipt of award. Appellant contends that it advised respondent that the ninety-day delivery schedule was unrealistic and that it was agreed that a realistic schedule would be submitted after award. Purchase orders issued under the contract called for delivery of the fixtures within 130 days (by March 13, 1994). On April 12, 1994, appellant s contract was terminated for default for failure to timely deliver the fixtures to the Government. Camtech appealed the default to this Board on June 29, 1994. The appeal was docketed as GSBCA 12894. On January 18, 1996, GSA issued a final decision demanding excess reprocurement costs from Camtech. Camtech appealed that decision to the Board on January 19, 1996, and that appeal was docketed as GSBCA 13522. Both appeals were consolidated on February 2, 1996. On October 8, 1996, the panel chairman convened the parties in an alternative dispute resolution (ADR) proceeding. At the conclusion of the ADR proceeding, the parties agreed to a settlement of the appeals. On February 3, 1997, the parties moved for dismissal of both appeals. Accordingly, pursuant to the request of the parties and Rule 128(a), these consolidated appeals are DISMISSED. ______________________ ALLAN H. GOODMAN Board Judge
