                                 ORDER
 
        Appellant,  Martinsburg  IRS Facility  Limited  Partnership,
   filed this appeal  on July 12, 1996,  challenging the contracting
   officer's  decision of April 29, 1996, concerning contract number
   MWV90015,  denying appellant's  claim  for costs  associated with
   filtering well water.
 
        On August 21, 1996, appellant  filed a motion to dismiss the
   appeal,  stating  that  counsel for  respondent  consents  to the
   motion.
 
        Accordingly,  this appeal is DISMISSED WITH PREJUDICE.  Rule
