ORDER Appellant, Blueridge General, Inc., was awarded a contract by respondent, the General Services Administration, for the renovation of the first and fourth floors of the Hoffman Courthouse in Norfolk, Virginia. On April 24, 1995, appellant requested that respondent issue a contract modification for a time extension of 187 days and compensation for 112 days, totaling $20,477.95. On November 14, 1995, appellant requested a final decision from the contracting officer on its April 24 request for additional time and compensation. No decision was issued by the contracting officer and, consequently, on January 30, 1996, appellant filed an appeal with this Board of a deemed denial of its claim for a time extension and compensation. The Board issued an order on February 6, 1996, suspending the normal proceedings for the processing of the appeal and directing the contracting officer to issue a decision on appellant s claim within thirty days or to provide an explanation as to why one should not be issued at this time. On March 6, respondent notified the Board that it would not be issuing a contracting officer s decision as respondent had accepted appellant s offer to settle this dispute and issued a modification to the contract. On March 11, appellant moved for this Board to dismiss its appeal with prejudice stating that appellant and respondent have entered into a bilateral modification resolving all disputes in the above captioned appeal.
