ORDER On October 4, 1994, the Board received an appeal filed by Valley Forge Flag Company, Inc., GSBCA 13002, contesting the termination for default of specific orders to provide flags under its contract with the respondent, the General Services Administration. On December 11, 1995, Valley Forge filed a second appeal, GSBCA 13487, consolidated with the former, challenging the assessment of excess reprocurement costs. On June 20, 1996, the Board received a copy of a modification to the contract and a request from Valley Forge to have the appeals dismissed with prejudice. In relevant part, the contract modification converts the terminations for default to terminations for the convenience of the Government at no cost to either party, with the Government not liable for Equal Access to Justice Act fees or any other costs.
