____________________________________________ DISMISSED WITH PREJUDICE: February 13, 1996 ____________________________________________ GSBCA 13422 POWER CONTRACTING AND ENGINEERING CORP., Appellant, v. GENERAL SERVICES ADMINISTRATION, Respondent. Jeffrey A. Karp, Executive Vice President of Power Contracting and Engineering Corp., Rolling Meadows, IL, appearing for Appellant. Marcy A. Sherrill, Office of Regional Counsel, General Services Administration, Chicago, IL, counsel for Respondent. DeGRAFF, Board Judge. ORDER On September 22, 1995, Power Contracting and Engineering Corp. (Power Contracting) filed this appeal challenging the contracting officer's final decision of June 22, 1995, denying its claim for equitable adjustment under contract GS05P91GBC0048 for the expansion of the United States District Court, in the Dirksen Federal Building and United States Courthouse, Chicago, Illinois. On January 22, 1996, GSA moved to dismiss this case because the parties agreed to the terms of a settlement. On February 9, 1996, Power Contracting advised the Board that it agrees with the motion to dismiss based upon the contracting officer's letter of February 2, 1996, confirming GSA's acceptance of the agreed upon compensation and stating that a formal modification to the contract in the form of a supplemental agreement will be forthcoming. Accordingly, this appeal is DISMISSED WITH PREJUDICE. Rule 28(a). ______________________________ MARTHA H. DeGRAFF Board Judge
