Complaint and Answer The complaint will be filed in accordance with Rule 7(b)(1). A copy of the complaint must be sent directly to Government counsel. A complaint is a concise statement of the facts of the claim and the reasons why it should be granted. The agency will file an answer in accordance with Rule 7(c)(1). A dispositive motion may be filed in addition to, but not in lieu of, an answer. Rules 7(c)(1), 1(d). Accelerated or Small Claims Procedure Under the Board Rules 13 and 14, if the amount in dispute is $50,000 or less, the claimant may elect to utilize the accelerated procedure, which provides for decision of the case within a 180-day period where possible. If the amount in dispute is $10,000 or less, the claimant may elect to proceed under either the accelerated procedure or the small claims procedure. The small claims procedure provides for decision of the case within a 120-day period where possible. Due to the short time periods involved in these procedures, the claimant must notify the Board of its election no later than 20 days after receipt of the appeal file. Hearing Each party may elect to waive a hearing and submit its case for a decision on the record pursuant to Board Rules 11 and 12 or either or both may appear at a hearing pursuant to Board Rules 19-25. If either party desires a hearing in this appeal, action must be taken to notify the Board no later than April 17. 1995. If a hearing is elected, also please furnish the following information after conferring with the opposing party. (1) A date and location agreeable to both parties, and (2) Expected length of hearing.
