(Ashton) was awarded contract number IBM 89-21 for the expansion of the Nogales International Wastewater Treatment Plant by the United States Section, International Boundary and Water Commission, United States and Mexico (IBWC). On September 23, 1994, the contracting officer denied Ashton's claim for $135,215.49, plus interest, for providing repairs to the aerator system and clay linings in the lagoons. Ashton appealed this final decision on December 27, 1994. On April 4, 1995, the parties filed a joint motion to dismiss stating that they had entered into an agreement in full settlement of the dispute effective on March 29, 1995, and requested the appeal be dismissed with prejudice.
