Jay P. Altmayer, Nancy Hirschler, Jane Beskin, AmSouth Bank, N.A., as trustee under the will of Claire Pollock, and Jay P. Altmayer and AmSouth Bank, N.A., as co-trustees under the will of Marvin C. Altmayer, entered into a contract to build-out and lease to the General Services Administration space in an edifice located in Savannah, Georgia. The lessor made to the contracting officer claims for additional payments for labor and materials allegedly provided during the build-out of the space. Among these were a claim for reimbursement of $42,525 for the installation of draperies, and another for reimbursement of $19,370 for the installation of above-standard carpet. The contracting officer granted each claim in part, determining that the Government owed the lessor $14,637.38 for the draperies and $13,411.32 for the carpet. The lessor appealed these decisions; the challenge to the former was docketed as GSBCA 12904 and the contest to the latter was docketed as GSBCA 12905. In each case, the lessor asked the Board to award it the difference between the amount of its claim and the amount granted by the contracting officer. The parties have now filed stipulations for entry of judgment in the two cases. In these stipulations, they ask the Board to award to appellant the amount of $3,289.89 in each appeal. The parties also certify that they will not seek reconsideration of, or relief from, a decision awarding these amounts; and that they will not appeal such a decision. Decision Each appeal is GRANTED IN PART. The General Services Administration shall pay to the lessor, within thirty days of the issuance of this decision, $6,579.78.
