DISMISSED WITH PREJUDICE: July 19, 1994 GSBCA 12501 SEAGRAVE COATINGS CORPORATION, Appellant, v. GENERAL SERVICES ADMINISTRATION, Respondent. Marla J. Moss of Tepperman & Moss, West Orange, NJ, counsel for Appellant. David L. Frecker, Office of General Counsel, General Services Administration, Washington, DC, counsel for Respondent. ORDER This appeal was filed on July 19, 1993, by Seagrave Coatings Corporation (appellant) against the General Services Administration (GSA or respondent) under contract number GS-10F- 52145, which was awarded to appellant for the manufacture and supply of certain paint products. Appellant alleges that respondent's rejection of twelve kits of epoxy primer and demand for payment of $2,587.20 was untimely as the GSA's right to terminate for nonconforming supplies had expired under the contract's one-year warranty period. The complaint and answer were filed and the parties engaged in limited discovery. On July 15, 1994, as a result of a settlement, respondent filed a motion for dismissal with prejudice on behalf of both parties. Accordingly, pursuant to the motion of the parties and Rule 28(a), this appeal is DISMISSED WITH PREJUDICE. _______________________ ALLAN H. GOODMAN Board Judge
