ORDER On May 14, 1993, Star Electric Company, Inc., filed an appeal of a General Services Administration contracting officer's rejection of a request for a change order under contract number GS-03P-92-DXL-0065 for installation of energy efficient lighting, Middle River Depot, Middle River, Maryland. This appeal was docketed as GSBCA 12433 and was consolidated with GSBCA 12345 on May 26, 1993. On June 10, 1993, appellant filed a motion for voluntary dismissal of GSBCA 12433, stating in pertinent part: 1. During a scheduling conference held on May 25, 1993, respondent's attorney . . . raised a concern that the claim contained in GSBCA No. 12433 had been improperly assigned. 2. In order to avoid litigating this issue, the parties have agreed that Star Electric should move to dismiss its appeal in GSBCA No. 12433 and that the completion surety, Employers Insurance of Wausau . . . would resubmit its claim for an equitable adjustment to the Contracting Officer and upon the issuance of a "final order," would bring the appeal in its own name and move to consolidate that appeal with GSBCA No. 12345. 3. Respondent's attorney has been contacted, and has agreed to the above outlined procedure and will not object. WHEREFORE, Star Electric respectfully requests that its appeal in GSBCA Case No. 12433 be dismissed without prejudice. Accordingly, appeal GSBCA 12433 is DISMISSED WITHOUT PREJUDICE.
