Santa Cruz, submitted a bid to purchase a 1988 Chevrolet Caprice sedan from the General Services Administration (GSA). Appeal File, Exhibit 3. On August 31, 1992, GSA notified Ms. Santa Cruz that it accepted her bid of $1,579. Appeal File, Exhibit 3. On September 3, 1992, Ms. Santa Cruz sent a letter to GSA and asserted that GSA had misinterpreted her bid. In her letter, Ms. Santa Cruz stated that her bid was $579, not $1,579. Appeal File, Exhibit 4. GSA treated Ms. Santa Cruz's letter as a claim and, on September 24, 1992, the GSA contracting officer denied that claim. The contracting officer determined that GSA's interpretation of Ms. Santa Cruz's bid was correct. Appeal File, Exhibit 7. On October 2, 1992, GSA assessed liquidated damages of $315.80 against Ms. Santa Cruz for failing to pay $1,579 and to take possession of the Chevrolet. Appeal File, Exhibit 8. On November 2, 1992, Ms. Santa Cruz mailed a notice of appeal to the Board. She requested relief from the contracting officer's decision that GSA's interpretation of her bid was correct and she also requested relief from GSA's assessment of liquidated damages. On February 1, 1993, the Board ordered GSA to supplement the appeal file with the abstract of bids or other evidence to establish the number of bids submitted for the Chevrolet and the amount of each of those bids. In response to the Board's order, GSA sent the Board a Notice of Confession of Judgment which states, "Please take notice that the General Services Administration herewith files this Confession of Judgment, and consents to the entry of Judgment in favor of the Appellant."
