ORDER This appeal was filed on September 17, 1992, by Action Building Systems, Inc. (appellant). Appellant was awarded a contract by the General Services Administration (respondent) for custodial services at a government facility in Del Rio, Texas, which required appellant to "machine sweep or wash down and remove oil spots" on a daily basis in the canopy area of the facility. On April 20, 1992, appellant submitted a claim to the contracting officer for rental fees of a mechanical sweeper in the amount of $832.54 per month from March 19, 1992, to the end of the contract period. The contracting officer denied appellant's claim on June 23, 1992. It is from that decision that this appeal arises. On May 4, 1993, the Board was advised that a settlement had been reached, and on June 15 the parties filed a joint stipulation for dismissal with prejudice.
