ORDER On August 31, 1992, the Board docketed an appeal filed by Braswell Services Group, Inc. from a contracting officer's decision of June 8, 1992, denying appellant's claim for $10,512 for its warranty repairs to the NOAA [National Oceanic and Atmospheric Administration] Ship CHAPMAN under contract number 50-EANA-2-00013, which was awarded to appellant by the respondent, U.S. Department of Commerce. On September 30, 1992, the appellant elected to proceed under the accelerated procedure, Board Rule 14. In response to the Board's order on proceedings, the parties elected a merits hearing for February 1993. On January 27, 1993, the Board received the parties' joint request for dismissal, dated January 15, which states: The underlying dispute in the subject appeal has been settled pursuant to a Settlement Agreement executed by Appellant on 11 January 1993. The parties jointly request that the Board dismiss the subject appeal with prejudice. Accordingly, this appeal is DISMISSED WITH PREJUDICE. Rule 28(a). ______________________________ JAMES W.
