DISMISSED WITHOUT PREJUDICE: March 22, 1993 GSBCA 11842 PIEDMONT POLYMERS, INC. Appellant, v. GENERAL SERVICES ADMINISTRATION, Respondent. Randy O. Wilt of Piedmont Polymers, Inc., Tucker, GA, appearing for Appellant. George U. Lane, Office of Regional Counsel, General Services Administration, Atlanta, GA, counsel for Respondent. GOODMAN, Board Judge. ORDER This appeal was filed on May 8, 1992, by Piedmont Polymers, Inc. (appellant). On August 13, 1990, appellant was awarded Contract No. GS-10F-51854 by the General Services Administration (GSA) for the supply of paints and sealants. On April 23, 1992, GSA issued a contracting officer's final decision alleging that appellant was in breach of the warranty provisions of the contract and further asserted a claim and demand for a refund of the contract price in the amount of $4,701.18 for allegedly defective materials. It is from this decision of the contracting officer that Piedmont Polymers appeals. On February 25, 1993, the Board was advised that the parties had reached a settlement. On March 15, 1993, the parties confirmed this fact in writing and moved for dismissal of this case. Accordingly, pursuant to Rule 28(a) and the request of the parties, this appeal is DISMISSED WITHOUT PREJUDICE. This dismissal will become one with prejudice fifteen days from the date of this order unless, prior to the expiration of that period, a party moves for reinstatement of the case. ___________________________ ALLAN H.
