DISMISSED WITH PREJUDICE: September 9, 1992 GSBCA 11835 SYLVAN SERVICE CORPORATION, Appellant, v. GENERAL SERVICES ADMINISTRATION, Respondent. J. B. McCarthy, Jr., President, Sylvan Service Corporation, Tampa, FL, appearing for Appellant. Robert J. McCall, Office of Regional Counsel, General Services Administration, Philadelphia, PA, appearing for Respondent. DANIELS, Board Judge. ORDER OF DISMISSAL On May 5, 1992, Sylvan Service Corporation filed an appeal regarding two claims on a contract for janitorial and related services at a federal building in Philadelphia, Pennsylvania. Shortly thereafter, the contracting officer resolved one of the matters to the contractor's satisfaction. The other -- whether the Government was justified in taking a deduction of $3,280.93 relating to the stripping of floors -- remained before the Board. On June 2, appellant elected to proceed under the small claims procedure. Rule 13. Two months later, the parties reported that they had reached a settlement. On September 8, the parties moved the Board to dismiss the case with prejudice. They attached to the motion a copy of the settlement agreement, which states that the Government has consented to remit half of the amount in dispute. In accordance with the parties' request, the case is now DISMISSED WITH PREJUDICE. Rule 28(a). _________________________ STEPHEN M. DANIELS Board Judge
