DISMISSED WITH PREJUDICE: April 14, 1993 GSBCA 11501-C(10504)-REM GILROY-SIMS & ASSOCIATES, Appellant, v. GENERAL SERVICES ADMINISTRATION, Respondent. Jerald S. Howe, Jr. of Steptoe & Johnson, Washington, DC, counsel for Appellant. Marie N. Adamson, Senior Assistant General Counsel, General Services Administration, Washington, DC, counsel for Respondent. BORWICK, Board Judge. Order This case involves a petition filed under the Equal Access to Justice Act (EAJA) for attorney fees and expenses of $27,071.90. We denied the petition because we considered the position of the agency to be substantially justified. Gilroy- Sims & Associates v. General Services Administration, GSBCA No. 11501-C(10504) (June 18, 1992). The United States Court of Appeals for the Federal Circuit disagreed and reversed and remanded to the Board "to determine the amount of EAJA attorney's fees and expenses due Gilroy-Sims." Gilroy-Sims & Associates v. Austin, No. 92-1439, slip op. at 7 (Fed. Cir. March 5, 1993). After issuance of the circuit court's mandate of March 26, 1993, the Board asked (among other things) if the parties had settled the question of amount. On April 9, the parties submitted to the Board a settlement stipulation and joint motion to dismiss with prejudice. The parties have agreed to a Government payment to appellant of $27,071.90. As the parties have settled the amount of EAJA attorney fees and expenses due Gilroy-Sims, the circuit court's mandate has been satisfied. Pursuant to Rule 28(a)(1), this case is DISMISSED WITH PREJUDICE. _________________________ ANTHONY S. BORWICK Board Judge
