ORDER On May 14, 1991, Hartford Fire Insurance Company filed an appeal from the contracting officer's denial of its claim for an equitable adjustment resulting from construction work done on a Department of Commerce National Oceanic and Atmospheric Administration Weather Service Office at Pleasant Hill, Missouri. Appellant sought $27,423 plus reasonable overhead and profit. On April 1, 1992, the parties requested that a hearing scheduled for April 22 and 23, 1992, be postponed until July 21 and 22. The Board later agreed to postpone this hearing until September 22 and 23. On July 31, the parties notified the Board that a tentative settlement had been reached and requested that proceedings in this case be suspended. On October 5, counsel for appellant requested that this appeal be dismissed without prejudice. Respondent has no objection to this request. In accordance with Rule 28(a), therefore, this appeal is DISMISSED WITHOUT PREJUDICE. This dismissal shall become one with prejudice ninety days from the date of this order unless one of the parties moves for reinstatement of the case prior to that time. ____________________ ROBERT W.
