_______________________________________________ MOTION FOR RECONSIDERATION DENIED: May 12, 1994 _______________________________________________ GSBCA 10118-R, 10119-R, 10120-R AIR SPEED TOOL COMPANY, Appellant, v. GENERAL SERVICES ADMINISTRATION, Respondent. Donald A. Dean, President of Air Speed Tool Company, San Carlos, CA, appearing for Appellant. John E. Cornell, General Services Administration, Office of General Counsel, Personal Property Division, Washington, DC, counsel for Respondent. Before Board Judges HENDLEY and VERGILIO.[foot #] 1 VERGILIO, Board Judge. By opinion dated September 30, 1993, this Board denied two appeals, and granted one appeal, of Air Speed Tool Company. Air Speed Tool Co. v. General Services Administration, GSBCA 10118, et al., 94-1 BCA 26,452. On November 8, 1993, the Board received from the contractor a motion for reconsideration of the three appeals. The contractor alleges that portions of six findings are in error, presents evidence previously in existence but not proffered by its counsel, and makes legal argument, some repetitious of that earlier made and some new. The agency maintains that the contractor has failed to plead any appropriate ground for reconsideration and asks that the request for reconsideration be denied. ----------- FOOTNOTE BEGINS --------- [foot #] 1 Board Judge Vincent A. LaBella, who was on the original panel in these cases, passed away on April 11, 1994. ----------- FOOTNOTE ENDS ----------- The contractor takes issue with findings of fact and conclusions of law of the Board. The contractor maintains a view of the documents and testimony which is, at times, at odds with that of the Board. The contractor has put forward no cognizable basis for the Board to reopen the factual or legal record in these cases or to reconsider the decisions. The Board DENIES the motion for reconsideration.
