For the reasons outlined in our decision of May 22, 1992, we award to Sterling Federal Systems, Inc. the amount of $517,436.30 (which includes $457,016.17 in attorney's fees and disbursements and $4,046 in witness' fees, which was the subject of our decision of May 22, 1992, and $56,374.13 in attorney's fees and disbursements for pursuit of the cost case itself). On August 7, 1992, we issued a Show Cause Order as to why the Board should not award Sterling $514,752.67. The additional $2,683.63 set forth herein represents the amounts identified in Sterling's Third Amendment to it Motion, dated September 16, 1992, for expenses incurred in pursuit of this cost case up to that date. The respondent did not respond to our Show Cause Order, but instead informed us on December 22, 1992, that its reason for not responding was that the matter is on appeal to the Court of Appeals for the Federal Circuit. That is not, however, so. Our decision of May 22, 1992, which the protester, Sterling Federal has appealed, denied the protester's claim of entitlement to additional amounts not involved or included in the costs herein granted. Not one cent of the costs herein awarded are the subject of an appeal. The appeal involves costs we declined to award to the protester. The award, $517,436.30, is to be paid, without interest, from the permanent indefinite judgment fund, 31 U.S.C. 1304 (1988). 40 U.S.C. 759(f)(5)(C)(1988). __________________________________ JAMES W.
